This website is operated by AEQEA. Throughout the site, the terms “we”, “us”, and “our” refer to AEQEA, including its owners, affiliates, employees, representatives, and assigns. AEQEA provides this website and all associated information, products, tools, and services (collectively, the “Service”) subject to your acceptance of these Terms of Service.
By accessing, browsing, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
These Terms apply to all users, including customers, vendors, collaborators, stylists, agencies, and contributors.
SECTION 2: ELIGIBILITY & CAPACITY
By using this Service, you represent that you are legally capable of entering into a binding agreement under applicable law. If you are under the age of majority, you confirm that you are using the Service with the consent of a parent or legal guardian.
If you are acting on behalf of an entity, you represent that you are authorised to bind that entity to these Terms.
SECTION 3: ACCEPTABLE USE
You agree to use the Service only for lawful purposes and in compliance with these Terms and applicable laws. You shall not misuse the Service, including engaging in fraud, unauthorised resale, intellectual property infringement, system interference, or any activity that disrupts or harms AEQEA or its users.
AEQEA reserves the right to suspend or terminate access where misuse is reasonably suspected.
SECTION 4: GENERAL CONDITIONS
We reserve the right to refuse service, limit access, or cancel orders where necessary, including in cases of suspected misuse, fraud, or policy violations. You agree not to reproduce, duplicate, sell, or exploit any portion of the Service without prior written consent.
SECTION 5: PRODUCT INFORMATION & PRICING
Product descriptions, images, specifications, and pricing are subject to change without prior notice. While we strive for accuracy, variations in colour, finish, or appearance may occur due to device differences or production processes.
Prices may be inclusive of applicable taxes, duties, and shipping where stated.
SECTION 6: ORDERS, PAYMENTS & FRAUD PREVENTION
AEQEA reserves the right to accept, reject, cancel, or limit any order at its discretion, particularly in cases of suspected fraud, unauthorised resale, or abnormal purchasing behaviour.
You agree to provide accurate billing and payment information. AEQEA may:
-Verify payment details before processing orders.
-Cancel transactions flagged as suspicious
-Restrict or block accounts involved in fraudulent or abusive activity
In the event of chargebacks or payment disputes initiated without valid grounds, AEQEA reserves the right to recover dues and associated costs through appropriate legal means.
SECTION 7: SHIPPING, DELIVERY & RISK TRANSFER
Delivery timelines are indicative and not guaranteed. AEQEA shall not be liable for delays caused by logistics partners, customs clearance, incorrect address details, or circumstances beyond reasonable control.
Risk and responsibility for products pass to the customer upon delivery or confirmed receipt. Any issues arising thereafter shall be the responsibility of the recipient, subject to applicable law.
SECTION 8: RETURNS, REFUNDS & CANCELLATIONS
Returns, refunds, and cancellations are governed by AEQEA’s separate Return Policy, as made available on the website. By making a purchase, you agree to those terms.
Where returns are accepted, products must be unused, undamaged, and in original condition unless defective upon receipt. AEQEA reserves the right to refuse returns that do not meet these conditions, in accordance with applicable law.
SECTION 9: THIRD-PARTY SERVICES
The Service may include third-party tools or links provided for convenience. These are provided “as is” without warranties or endorsements. AEQEA is not responsible for third-party services, policies, or failures.
SECTION 10: USER CONTENT & SUBMISSIONS
By submitting any content, including feedback, reviews, or media, you grant AEQEA a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for business purposes.
You agree not to submit content that is unlawful, misleading, defamatory, or infringing on any third-party rights.
SECTION 11: ERRORS & INACCURACIES
AEQEA reserves the right to correct errors, inaccuracies, or omissions at any time, including after an order has been placed, and may cancel or adjust orders where necessary.
SECTION 12: DISCLAIMER OF WARRANTIES
To the extent permitted by applicable law, all products and services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
SECTION 13: LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, AEQEA shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business interruption.
In all cases, AEQEA’s total liability shall not exceed the amount paid by you for the relevant product or service.
SECTION 14: INDEMNIFICATION
You agree to indemnify and hold AEQEA harmless from any claims, damages, liabilities, and expenses arising from your breach of these Terms, misuse of the Service, or violation of applicable law or third-party rights.
SECTION 15: GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Delhi, unless otherwise required by applicable law.
SECTION 16: MODIFICATIONS TO TERMS
AEQEA may update or modify these Terms from time to time. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
SECTION 17: OWNERSHIP, RISK & LIABILITY TRANSFER
All products become the responsibility of the recipient upon delivery or confirmed handover. AEQEA shall not be liable for loss, theft, or damage thereafter, except where required under applicable law.
SECTION 18: FORCE MAJEURE
AEQEA shall not be liable for delays or failure to perform obligations due to events beyond reasonable control, including natural disasters, logistics disruptions, governmental actions, or technical failures.
SECTION 19: NO WAIVER
Failure to enforce any provision of these Terms shall not constitute a waiver of such provision or any other rights.
SECTION 20: ENTIRE AGREEMENT
These Terms constitute the complete agreement between AEQEA and the user and supersede all prior communications.
SECTION 21: SOURCING – TERMS & CONDITIONS
This section applies to all sourcing, styling, PR, influencer, agency, and collaboration arrangements where AEQEA products are temporarily provided for use and later returned.
This section overrides any conflicting general terms of the website specifically for sourcing arrangements.
By accepting AEQEA products, the sourcing party automatically agrees to these terms in full.
21.1 Ownership of Products
All AEQEA products provided under sourcing arrangements remain the sole property of AEQEA at all times.
No ownership is transferred unless explicitly confirmed in writing by AEQEA.
Products are provided strictly on a temporary basis for styling, content creation, shoots, or promotional use.
21.2 Full Responsibility
From the moment products are dispatched until AEQEA confirms full receipt and successful inspection, complete responsibility for all items lies with the sourcing party.
This includes all circumstances without exception:
- damage
- breakage
- loss
- theft
- misplacement
- missing items or components
- courier or logistics handling issues
- third-party handling or usage
Responsibility cannot be shifted to any courier, insurer, or third party under any circumstance.
21.3 Return Completion & Finality Rule
A sourcing arrangement is considered fully complete only when both conditions are met:
- All items are physically received by AEQEA
- AEQEA has completed inspection and confirmed their condition
Until both conditions are fulfilled, full responsibility remains with the sourcing party.
Delivery confirmation, tracking status, or dispatch proof does not constitute return completion.
21.4 Missing Items
Any item not returned in full will be treated as missing, regardless of reason.
This includes courier loss, partial return, or internal handling issues.
All missing items will be billed at full retail price (MRP), without exception.
No reduction or adjustment will apply based on:
- courier compensation
- insurance payout
- partial recovery
- third-party settlements
21.5 Damaged or Unsellable Items
Any item returned in damaged, broken, incomplete, or unsellable condition will be treated as fully non-recoverable and billed at full retail price (MRP).
Damage includes:
- structural breakage
- missing parts or components
- missing stones, clasps, or attachments
- deformation or alteration
- any condition preventing resale as new
Partial usability does not reduce liability.
21.6 Courier and Third-Party Compensation
Any compensation, insurance payout, or reimbursement from courier or third-party logistics providers is completely independent of AEQEA.
Such payments do not reduce, offset, or cancel any liability owed to AEQEA under this agreement.
21.7 Evidence and Final Determination
AEQEA will rely on its internal records for all decisions regarding condition, return, and liability, including:
- dispatch photos and videos
- packaging documentation
- inventory records
- return inspection report
These records shall be considered final and binding for billing and assessment purposes.
External documentation, including unboxing videos or third-party reports, is not required for validation.
AEQEA’s inspection findings will be final.
21.8 Reporting Window
Any issue relating to missing, damaged, or incorrect items must be reported within 72 hours of delivery.
After this period, claims may not be accepted due to inability to verify condition accurately.
21.9 Payment & Non-Dispute Clause
All amounts raised for missing or damaged items are valid commercial dues and must be paid within the timeline mentioned in the invoice.
Liability is independent of any dispute raised with third parties, including courier companies.
Non-payment will result in:
- suspension of future sourcing or collaboration
- refusal of further services
- recovery proceedings under applicable law
- recovery of reasonable administrative and legal costs
21.10 Agreement & Acceptance
By accepting AEQEA products under any sourcing arrangement, the sourcing party confirms that they:
- have read and understood these terms
- agree to be bound by them
- accept full liability under this section
Acceptance of goods constitutes full acceptance of these terms.
SECTION 22: ON APPROVAL BASIS – TERMS & CONDITIONS
Products issued on an approval basis are conditional and not complimentary unless explicitly stated in writing.
Any product that is used, worn, photographed, published, retained, or not returned may be treated as accepted and billed at full MRP.
Damaged, altered, lost, or unsellable products may also be billed accordingly.
AEQEA retains the right to reasonably determine classification and billing under this clause.
SECTION 23: INTELLECTUAL PROPERTY
All content, including designs, branding, images, and materials, is the property of AEQEA and is protected under applicable intellectual property laws. Unauthorised use is prohibited.
SECTION 24: TERMINATION
AEQEA may suspend or terminate access to the Service where these Terms are breached. Obligations and liabilities incurred before termination shall survive.
